A federal appeals court ruled Friday that Jose Padilla, held for more than three years after federal officials said he planned to set off radiological devices known as "dirty bombs," can be detained indefinitely without trial.

No...that doesnt matter. The patriot act does not exclude American citizens in the provision they just affirmed.

so a US citizen is better than a non US citizen, therefore deserving of fairer treatment?
Apparently that has been overturned by one of the "Activist Judges" the republicons are always ranting about.
I mean, Habeus Corpus is only in our constitution - it's no big deal. We need to worry about those judges who try to let husbands decide the fate of their vegetable-wives, and set nasty precedents upholding people's rights to the pursuit of happiness over the interests of America-nurturing mega-corporations.

I just read in our local paper that there is a guy here who's been detained for alleged murder, since August without a hearing or a lawyer.
Doesn't make any sense bud. I'd need to see that in the paper cause you just can't do that, the court case would likely be thrown out if it was brought in front of a court so it doesn't make sense they'd do that with a murderer. Imagine who's heads would roll if they let a killer slip through because of a technicality? I'm not buying it man.

Outside of the initial explosion people would have to stand perfectly skill for upwards of a decade for the radioactive material to cause any kind of health impact.

Yeah but something like the patriot act could be challenged again and in light of non crazy people in the courts I doubt it'd hold up based on human rights violations. That's why when you guys get all flustered over these laws they are trying to make that really it's just like a fad. OMG BBQWATERMELLONS!!!!
Any law that doesn't seem right can be challenged and the fact is detaining any free individual is indeed infringing on those core human rights issues. Now if it was a dude with a previous record being denied bail then yeah, I can understand that but that's why that's the way it is. You can't just detain a person.
Unless they look like they're from the middle east.
seriously though it's a bad law and should be challenged
