They're talking about sendng icons over IM, not forums... Now if q3w decided to implement a system were you could upload your own icons and have them spawn automagically on everyone else's computer then maybe they'd have a case

So any forum with a file attachment feature, or AOL Instant Messenger which you can use AIM Expressions with? (Different sets of emoticons. I believe you can hack them and make your own.)

the patent is also confined to real-time communications. I don't consider a forum real-time.

I think this is for a biometric-like technology that will use a camera to record the emotional state of your face as you sit in front of your computer and then represent it in an avatar of some sort that changes dynamically with your emotions.

Maybe you should patent body actions for generating icons... it could be your cash cow someday.
The first "implementation" is about pumping image data over the connection along with the message and redrawing on the other side.

wait, did they patent "emoticons" or smileys? i mean those "emoticunts" are those annoying little yellow fuckfaces in msn they made right, while smileys are just character sequences used for over 20 years
