That's just there so that Filefront can cover their own ass if someone starts whining about people stealing their stuff and putting it there for free.

That's covered amply further on in the ToS. Also, if a document designed to forge a legal contract contains clauses which can be shown unenforcable and/or absurd, my understanding is this pretty much nullifies the whole thing.

Actually you're not.

The text that says "Except as specifically provided herein" means that, on their terms, the file can be distributed. They've provided the file to be downloaded....and that's where the distribution is supposed to stop.

If you were to distribute the file from your computer to others then it would breach the EULA because the file wasn't distributed by them.

Of course all those run-on sentences (there are only two in the quoted portion) are annoying and really take the scenic route to the point.

I'm no lawyer but it seems to be clear.

I have always wondered about one little trick File Front / File Planet and other "pay-to-use" download services use, that goes against all the mod maker's intents.

Sample from a Read Me file created by a modder:

" You may not include or distribute this map in any sort of
commercial product without permission from the author."

Is File Front or File Planet required to ask permission from the mod author to host the mod on their site since part of their site is a pay to use site?

Nope, because it's free. Only subscribers pay, and thats only to 'not wait in line' not to pay for your mod or map.

No, the subscribers are paying for the privilage of downloading it from fast servers, not for the privilage of actually downloading the file or content itself.
