I would think that maybe some sort of civil suit, because of tort law or whatever it is that goes something like 'but for the action of so and so person, this thing wouldn't have happened to me...' or something like that if I remember it right from judge judy. my friend is currently running for a judge position here, i'm going to ask him if he's ever heard of anyone winning any type of settlement for a clerical error resulting in improsonment/lost wages/etc.

oh, and the speeding was bullshit because he supposedly got me with radar from an almost perfect perpendicular angle as we were both approaching a T-Intersection. (i was on the straight through)
Unless he has some uber-powerful radar gun which can penetrate the house on the corner without setting off my detector... Or physics has changed in the last few years; It's virtually impossible for him to have gotten a reading at all, let alone something remotely accurate.
Truth of that matter however, is i'm not even sure if I was speeding. if I had to guess i'd say i may have been doing 38-ish in a 30; he wrote me for 42. But I'd just stopped at BK for breakfast and was reaching into the pasenger seat to unwrap my completely unhealthy nosh; so my usual glances for the speed-o were directed elsewhere at the time.
In that situation: him eye-balling my speed... and me not knowing either. i think i deserve the benefit of the doubt; but since the burden of proof in this country rests on the shoulders of the accused... you never know.
At any rate, my lawyer wasn't worried at all about making either chrage dissapear... I just have to eat the cost and the huge inconvienence, and the "interesting" experience of having all my freedoms stripped away for a day.
I still blame nixon for the status quo... ever since the drug war started this country has been turing into a police state. It's not exactly martial law... but any poice that wants to abuse his power can find an excuse to hassle pretty much anyone anytime.

one day a cop out of uniform pulled my brother over and wanted him to show up the next day to teach him about proper driving procedures :OLO: fucking cunt he was so out to get him. Not only was he a fucking prick, he didn't even want to inconvinience his donut route to radio a uniformed cop on the scene to handle it, instead he wanted him to show up the next day at the police station. :icon27:

now i'm allowed to drive and have my car back... so now I just need to pay the lawyer and forget this happened. The american way, just throw money at a problem until it goes away.
after another day of wasted time (skipped 2 classes):
$20 worth of DMV fees and $180 for towing and impound fees.

Well, as far as I know, it's a pretty big deal to skip your Miranda Rights. There's a good reason they have to say them.
Also, in my state, when your license is revoked/suspended you have to be served, which means the paper has to be physically handed to you by an officer. Dunno if this applies in your state.
Hope everything pans out for you, man. It strikes me odd that you don't have lawyers clamoring to get on board for this one.
If all else fails, you may want to present it to your local paper and see if they'll run it as some sort of community advocation piece.

Last Monday one of the secretary's husbands was in a fender bender in a parking lot. The woman jumped out and threw her drink on him. He started yelling at her...as the cops pulled up, they saw her take her shoe off and throw it at him. So they jumped out, but him in handcuffs without asking any questions and stuffed him in the back of the cop car. He died back there of a heart attack.
Ends up he was a 27 year vetern of the police force, retired from there and became a fire fighter. But they never asked him any questions. Just cuffed him and stuffed him. By the time they came back to the car to ask him his side of the story, he was already dead.
Oh yeah...there's gonna be a law suit. Believe me, the cops are gonna get boned for that.
And since he really was a good guy, not a rager at all, I believe they're going to go after the woman that assaulted him too.
